Deposit Rs 25,000 in police welfare fund to quash false rape FIR, Bombay HC asks complainant

The Bombay high court on Tuesday directed a woman to deposit Rs 25000 to the state police welfare fund as a condition while quashing her false rape FIR against her boyfriend. She had approached the HC to have the case quashed.

A bench of justice RD Dhanuka and justice VG Bisht said it cannot simply accept her contention that she was pressured by her family to file the criminal case in March this year. Her lawyer SS Dubey said “to protect herself from the wrath of her elder sister, the petitioner developed a fake story’’ which she no longer wishes to pursue.

Additional public prosecutor Aruna Pai strongly opposed her petition and sought imposition of “heavy costs’’ on her as she had put the police on the job in a false complaint.

The HC said the money should be deposited in four weeks, else its order to quash will stand vacated. It placed the matter on October 6 for compliance report.
