The Allahabad High Court has granted a relief to a medical intern who questioned the order of May 6 which directed that all medical interns in the State to return back to their parent colleges amid the COVID-19 pandemic. The single judge bench comprising Justice Manish Mathur has directed the state authorities to file a counter affidavit in the matter within 3 weeks. Further it was ordered that the order of 6th May, 2020 shall remain stayed.
It was submitted that on March 20, the State had issued directions for the petitioner to continue her internship in the Dr. Shyama Prasad Mukherji Civil Hospital, Lucknow. However on May 6, a notification was issued by the Principal Secretary of Medical Education, Uttar Pradesh for medical interns to join their original medical college.
It has been argued that the order of May 6 has been passed without using any application of mind and without taking into consideration the seriousness of the COVID 19 pandemic, whereas the guidelines have been issued by the State Government restricting inters district transfer.
Considering the arguments of petitioner, the Court has granted three weeks to the State to respond to this matter. This matter further up would be taken in June.
